Real Estate acquisition for beginners I Andrzej Lulka i Wspólnicy I Workshop

We are happy to pass on the invitation of Andrzej Lulka i Wspólnicy law firm to the online workshop titled: "Real Estate acquisition for beginners" which will be held on Wednesday, the 22th of May 2024 between 10:00 AM and 2:30 PM. 

The workshop will focus on the basic concepts and issues related to Real Estate acquisition. The most important legal regulations relating to real estate and its acquisition will be presented, types of real estate transactions, the conditions of real estate development will be introduced, and public registers containing information on real estate will be discussed.

The terms and clauses of the real estate purchase contract, which most are the most important and which are most often negotiated by the parties to the contract, will also be presented. In addition, the organisers will tell you what you should pay special attention to when preparing for a real estate transaction and what are the potential risks for the buyer and how to avoid them. Participants in the workshop will also learn about the methodology of legal examination of real estate (so-called due diligence).

The workshop is addressed to all those wishing to gain or expand their knowledge in the broad field of real estate.

The workshop will take place in Polish. 

TRAINING PROGRAMME

1. Introduction

  • Basic concepts
  • Types of real estate
  • Regulations governing real estate and its acquisition
  • Forms of ownership of real estate (legal title)
  • Encumbrance on real estate by limited rights in rem

2Due diligence

  • Concept of due diligence
  • Scope of due diligence
  • Methodology - how the examination proceeds and what stages does it include
  • Purpose of the legal examination of the real estate - what do we want to find out?
  • Remedies - how do we use the findings of the legal examination of the property?
  • Most common defects in real estate

3. Development conditions of the real estate

  • Local zoning plan
  • Decision on development conditions
  • Public purpose investment location decision
  • Main changes to spatial planning regulations

4. Public registers containing information on real estate

  • Land registers structure,
  • Land register files,
  • access to land and mortgage registers,
  • ordinary and full copies,
  • documents constituting the basis for entry,
  • entries in the land and mortgage register
  • warning about discrepancies between the legal status disclosed in the land and mortgage register and the actual legal status
  • warning on execution
  • Land and Building Register (pol. EGiB):
  • what information does the EGiB contain?
  • access to the information contained in the EGiB
  • registration certificate
  • extracts from the EGiB

 5. Real estate purchase transaction

  • Parties to the agreement and their proper representation
  • Types of real estate transaction - what is an asset deal, share deal and business deal?
  • Preliminary agreement and final agreement
  • The most important contract terms and clauses to be negotiated
  • Documentation necessary for the transaction

 6. Summary, questions and answers

 

Costs:

- 499 PLN + VAT / person, if you register by 07.05.24,

- 699 PLN + VAT / person, when registering from 08.05.24 to 22.05.24

Duration of workshop: 4 hours + 30 minutes break (total 4.5 hours)

Each participant, the day before the scheduled workshop, will receive a personalised link to access the platform where the training will be conducted.

During the workshop, it will be possible to ask questions to the speakers in the chat room. The presentation will be available to all participants.
